Abstract
Intellectual Property Rights (IPRs) have become central to international trade, innovation policy, and economic competitiveness in the global market. As businesses expand across borders and digital technologies reshape commerce, the protection and enforcement of intellectual property present complex legal and economic challenges. This study examines the role of IPRs—including patents, copyrights, trademarks, and trade secrets—in facilitating global trade while addressing the regulatory, enforcement, and harmonization issues that arise in diverse jurisdictions.
The research analyzes the impact of international agreements such as the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, WIPO conventions, and regional trade agreements in shaping global intellectual property governance. Particular attention is given to issues such as counterfeiting, piracy, parallel imports, technology transfer disputes, digital infringement, and disparities in enforcement capacity between developed and developing economies. The study also explores the tension between strong IPR protection and concerns related to public health, access to technology, and market competition.
Through comparative policy analysis and case-based evaluation, the paper highlights how inconsistent legal standards, jurisdictional conflicts, and rapid technological change create persistent challenges in the global marketplace. The findings suggest that while robust intellectual property protection promotes innovation, foreign investment, and brand value, overly rigid systems may hinder knowledge diffusion and economic inclusivity. The study concludes that greater international cooperation, harmonization of standards, and adaptive regulatory frameworks are essential to effectively manage intellectual property challenges in the evolving global market.
